Why is sick leave in the Netherlands so costly for employers?

Dutch law puts the cost of sickness on the employer, not the state. When an employee cannot work because of illness, you keep paying salary for up to 104 weeks: at least 70%, and often 100% in the first year under a collective labour agreement (CAO) or the employment contract. You are also responsible for getting the employee back to work.

The Gatekeeper Improvement Act (Wet verbetering poortwachter) prescribes the steps, from the company doctor's problem analysis to the reintegration report, each with its own deadline in the timeline below.

When the employee applies for a WIA disability benefit, UWV checks those steps and can impose a wage sanction (loonsanctie) of up to 52 extra weeks of salary if your efforts fall short. Privacy rules add a layer: you may not ask about the diagnosis, so your process has to work without it.

What does a sick employee cost an employer in the Netherlands?

Continued salary is only part of the bill. You often pay for replacement cover too, along with company doctor consultations, any reintegration provider and the time managers spend on the case. Holiday keeps building up during sickness, so a long absence leaves a large balance. If UWV later finds the reintegration efforts insufficient, a wage sanction adds up to a further year of salary.

Many employers spread the risk with absence insurance (verzuimverzekering), a private policy that reimburses part of the salary and often includes case management. Every employer also pays a Return to Work Fund (Werkhervattingskas) premium covering partial disability benefits (WGA) and sickness benefit for former temporary staff (Ziektewet). You can instead become a self-insurer (eigenrisicodrager, ERD) through the Dutch Tax Administration and carry those benefits and the related reintegration yourself, for up to ten years in the case of WGA.

How first and second track reintegration works in the Netherlands

Reintegration starts in the first track (eerste spoor): a return to the employee's own job, adapted work or another suitable role in your organisation, often building up hours step by step. Suitable work (passende arbeid) depends on what the company doctor says the employee can do, and an employee who refuses it without good reason can lose the right to salary.

When a return within your organisation is no longer realistic, the second track (tweede spoor) begins: finding suitable work with another employer, usually through a specialised reintegration provider. UWV expects it to start as soon as that is clear, and the first-year evaluation is the latest point to decide. A bill sent to parliament in 2026 would let small and medium-sized employers, with the employee's consent or UWV's approval, focus fully on the second track from year two. It is planned for 2030 at the earliest and is not law yet.

After week 104

What happens after two years of long-term sick leave?

If the employee applied for WIA in time and UWV accepts the reintegration report, salary continuation ends after 104 weeks. UWV then decides on the benefit: IVA for employees who are fully and permanently unable to work, WGA for those who can still partly work or may recover, and none below a 35% loss of earning capacity. If UWV finds gaps, it first imposes a wage sanction.

The dismissal ban ends at the same time as salary continuation. If recovery within 26 weeks is not expected and no suitable work is available in that period, you can apply to UWV for a dismissal permit or agree a termination. The statutory transition payment is then due, but under current rules you can claim compensation for it from UWV. The government plans to restrict and later end that scheme, so check before you act.

  1. 01 Day 1

    Sick report and first contact

    We open the case on the day the employee reports sick, check that your occupational health service (arbodienst) is notified, and contact the employee about availability, expected duration and practical arrangements, never medical details.

  2. 02 Week 6

    Problem analysis

    We make sure the company doctor delivers the problem analysis by week six, then translate the advice into plain conclusions about what the employee can and cannot do.

  3. 03 Week 8

    Plan of action

    With you and the employee, we draft the plan of action (plan van aanpak) by week eight: concrete reintegration goals, adapted work where possible and who does what. We review it at least every six weeks.

  4. 04 Week 52

    First-year evaluation

    Around week 52, we lead the first-year evaluation (eerstejaarsevaluatie): is a return to own or adapted work realistic, or should the second track (tweede spoor) start, if it has not already?

  5. 05 Week 93

    Reintegration report and WIA

    If the employee is still unable to work, we compile the reintegration report (re-integratieverslag) so the WIA application can be filed by week 93, with two years of steps documented for UWV.

Sick leave mistakes international employers often make

Counting sick days

Head office policies often cap paid sick days. The Netherlands has no such cap: salary continues for up to 104 weeks, and no contract can lower the statutory minimum. A policy that stops pay after a set number of days will not hold.

Waiting until week 6

Week six is the deadline for the problem analysis, not the moment to call the company doctor. With stress, burnout or conflict at work, early involvement matters, so act as soon as a long absence looks likely.

Starting the second track too late

When a return to your organisation is unrealistic, UWV expects the search for work elsewhere to start then, not near the end of year two. A late or token second track is a common reason for a wage sanction.

Letting the file go quiet

UWV judges your efforts on paper. Evaluations never recorded, a plan of action never updated or emails scattered across inboxes all weaken the reintegration report. Keep one complete file from the first day of absence.

Dutch sick leave terms explained

Wet verbetering poortwachter (Gatekeeper Improvement Act)
The 2002 law setting out what employer and employee must do in the first two years of sickness to get the employee back to work.
Bedrijfsarts (company doctor)
A registered occupational physician who assesses fitness for work and advises on reintegration. Medical information stays with them; you receive only work-related conclusions.
Plan van aanpak (plan of action)
The reintegration plan that employer and employee agree within two weeks of the problem analysis, setting the goal, the activities and who does what.
Eerste en tweede spoor (first and second track)
First track: a return to suitable work in your own organisation. Second track: suitable work with another employer, once the first track will not succeed.
Re-integratieverslag (reintegration report)
The file submitted with the WIA application, covering the problem analysis, plan of action, all evaluations and a current assessment by the company doctor.
Loonsanctie (wage sanction)

How much sick pay does an employer pay in the Netherlands?

By law, at least 70% of salary for up to 104 weeks, and at least the minimum wage in the first year. The 70% is capped at 70% of the maximum daily wage for social insurance, and many CAOs and contracts pay 100% in year one. Up to two unpaid waiting days are allowed only if agreed in writing.

Can I ask my employee what illness they have?

No. You may not ask about or record the diagnosis or symptoms, even if the employee volunteers them. You may record contact details, the expected duration, appointments and work to hand over, and whether an accident or a safety-net provision applies. The company doctor tells you only what the employee can and cannot do.

Do employees need a doctor's note when they call in sick?

No. The Netherlands has no sick note system, and you cannot demand a certificate from the employee's own GP. The employee reports sick under your absence policy. If you doubt whether they are fit for work, ask the company doctor to assess it; you can do so from the first day of absence.

Can I dismiss an employee on sick leave in the Netherlands?

Generally not during the first 104 weeks. Dutch law bans giving notice to a sick employee, with narrow exceptions such as summary dismissal or an illness that began after UWV received your dismissal application. A termination by mutual agreement is possible but carries risks for both sides. After 104 weeks, or later after a wage sanction, a dismissal permit becomes possible.

What happens if we miss a Gatekeeper Act deadline?

UWV reviews your reintegration efforts when the employee applies for WIA. If it finds them insufficient without good reason, it can impose a wage sanction of up to 52 extra weeks of salary. A late plan of action, missing evaluations and a late second track are common causes. Repair gaps quickly: UWV can shorten a sanction once the shortfall is fixed.

What can I do if a sick employee does not cooperate?

Check that your instructions were clear and recorded, then warn the employee in writing. If they still ignore reasonable absence rules, you can suspend salary; if they refuse suitable work or reintegration steps without good reason, you can stop it. When you disagree about fitness for work, either side can ask UWV for an expert opinion (deskundigenoordeel).

How should I handle frequent short-term absence?

Talk to the employee after each sick report and look for patterns, such as workload, conflict or particular days. Many employers treat three or more reports in 12 months as frequent absence and ask the company doctor to see the employee. Sickness periods less than four weeks apart count as one. Dismissal for frequent absence is possible only exceptionally, through the court.

Do we still need an arbodienst if HRhelp manages the case?

Yes. Every Dutch employer must arrange occupational health support and access to a company doctor, through an arbodienst or a contract with a certified doctor. HRhelp does not replace the company doctor. We work alongside them, make sure their advice is acted on, and manage the process and deadlines around it.
